Ever since the early 1900s and the Great Trade-Off, when laborers gave up the right to sue employers for workplace injuries in exchange for no-fault insurance, workers compensation insurance law has effectively protected workers in Davis, Weber and the surrounding counties.
I know the history and the importance of workers compensation law, and I know how to make the law work for you. My name is Melvin A. Cook and I am a Salt Lake City worker compensation attorney. I proudly represent injured workers and give them my best effort every day to obtain the compensation they deserve.
For injured workers, “no-fault” insurance means that you do not have to prove that your employer caused your workplace injury. You do have to prove that the injury occurred while at work and during the normal course of business. Immediately after I file your claim, I begin investigating the facts to make your case as strong as possible in the event of an insurance company denial.
In 2011, nearly 3 million American workers filed a workers compensation claim. The injury usually falls into one of these categories:
Workers compensation benefits in the Salt Lake City area generally include compensation for lost wages and medical bills. To determine the amount of lost wages, there is a formula that uses the average wage in Utah and the workers’ disability. For example, if the doctor determines that you are 50 percent disabled, you would receive a maximum $1,638.30 per month (50 percent of the average wage, which is currently $762 per week). Compensation for medical bills and prosthetic devices may also be available.
Utah workers cannot sue their employers outside of workers compensation for personal injury or negligence. However, if you can show intentional or egregious conduct, some courts may allow it. Workers compensation does not affect your right to sue a third party, such as a negligent co-worker or defective product manufacturer.
