Adoption of an Adjudicated Child and Child’s Social Security Benefits

C was the illegitimate child of his father F and mother M. A court in New York adjudicated F to be C’s father in 1964. In January 1966 C became entitled to child’s social security benefits on the earnings record of his deceased mother.

The question was whether or not F’s adoption of C would terminate the child’s social security insurance benefits. The answer was no because there was already a legally recognized parent-child relationship.
