R filed an application for social security disability insurance benefits in February 1964. In his application he listed four biological children born to him out of wedlock. He identified W as the children’s mother. R indicated that he and W had never married.

R died as a domiciliary of Louisiana on October 10th, 1964. W applied for children’s social security benefits for the four children based on R’s work record. She provided evidence that R had acknowledged the children in writing on a state application for welfare benefits.

Under these circumstances the children qualified for social security benefits based on R’s earnings record.
