P served on active duty in the military from 1914 through 1945. Once he achieved 30 year of active duty in the military, he was entitled to military retirement benefits.

But even though P was retired from the military on April 30, 1944, he was called up to serve in World War II from May 1 1944 throwback December 31, 1945.

Under the legal at the time, World War II veterans were granted $160 per month of social security wages credits for their service during World War II.

P applied for old age social security insurance benefits in December 1962, claiming that his military service during World War II from May 1944 through December 1945 was not covered by his veterans retirement pay and should therefore be covered by social security.

P met all the requirements to receive $160 per month in social security wage credits for his post-retirement service during the war. However, since P was already receiving Veteran’s retirement pay based in part on service during World War II, he did not qualify for social security retirement benefits.
