Certain cooks were hired, paid, and supervised by sheriff’s in certain counties in Indiana. It was held that these cooks were employees of the counties, and not personal employees if the sheriffs. Therefore, they were covered by the section 218 agreement between Indiana and Social Security.

A section 218 agreement is an agreement between Social Security and a State to provide Social Security and Medicare Hospital Insurance (HI) coverage, or just Medicare HI coverage, to State and local government employees.

See Social Security Ruling (SSR) 65-57.
