On February 1st 1962 R became entitled to old age social security benefits while living in New York.

He moved to the Philippines in November 1962 and married W in October 1963. In September 1964, W’s niece C began living with the couple. They adopted her on July 31, 1965.

On September 23rd 1965 W filed an application for child’s social security benefits on behalf of C based on R’s work record.

However, the application was denied on the grounds that C was not receiving one-half of her support from R in the year preceding the time he became entitled to social security benefits, nor was she living with him at the time he became entitled to benefits.
