A social security retirement beneficiary, who was a retired veteran, was confined to a VA nursing home in Tuscaloosa, Alabama, where all of his needs were being met. Because of his declining mental capacity, he was unable to manage his benefits in his own interest and his wife was the representative payee for his social security benefits.

His wife asked Social Security if she could use her husband’s retirement benefits to maintain the family home in Bessemer, Alabama. The agency verified from the nursing home that all of her husband’s needs were being met at the nursing home.

The agency determined that, because the husband was under a common-law duty in Alabama to provide necessities and support to his wife and children, his wife could use his benefits for maintenance of the family home.
